FBI to conduct new investigation of emails from Clinton’s private server

Just when she thinks it's over, they pull her back in. Congrats, RC; I'm sure this was a welcome development.


Here's a question for people who know stuff: If Hillary wins the election but gets indicted and resigns before she and Kaine are sworn in, who becomes president? Kaine, even though he isn't yet VP? Not predicting this will actually happen, but what if it did?

Obama is still the president until the next president is sworn in.


Sure, but who would that person be? Tim Kaine? Somebody else? Or would there need to be another election? Surely there is an answer to this question. Obama can't serve another term, so somebody would need to become president.


I'm starting to think it might be James Comey.


logically it would be tim kaine, but the republicans would certainly file a legal challenge and the supreme court will be deadlocked 4-4.

Donald Trump will claim it as inherently his, Paul Ryan will resign before someone asks him to do it, Mitch McConnell will obstruct it, Alexander Haig will say he's in charge from his grave.

Maybe the answer is Joe Biden, as the current VP at the time? Or perhaps Kaine is sworn in as VP when the time comes, then immediately becomes president due to there not being one?

If a winning Presidential candidate dies or becomes incapacitated between the counting of electoral votes in Congress and the inauguration, the Vice President elect will become President, according to Section 3 of the 20th Amendment.

Hmmm.. The FBI director, who has previously been very deferential to a presidential nominee, suddenly re-opens a criminal investigation into that nominee 11 days before an election. That's just "media garbage"? What would make it a legitimate story then?

If this turns out to be a nothingburger, it will still be calories for the Hillaryhaters. ("Remember when Comey had to reopen the investigation?")

No amount of truth (it hasn't been reopened, it was never officially closed, and Comey appears to have just notified the committee that there was something tangentially related to it) will change that.

If nothing else, it gives Chaffetz cover for his shame in supporting Trump.

Yeah, investigators should never, ever look to sourcesand evidence beyond the specific thing they are investigating.

A murder investigation? We have a body and a suspect. Why bother interviewing any witnesses? Our investigation is strictly about the murder victim and the suspect.

couple thoughts


It's not a "nothing burger". FBI directors don't send letters to congress 11 days before an election over nothing.

The FBI seized Anthony AND HUMA Weiner's equipment. It appears those had "lost" emails. What the content is, who knows. But the point would be that these emails SHOULD have been on the server but were not. The natural question is why.

A president can be under criminal indictment as far as I know and still be President. We have a separation of powers that delegates the removal of a President to the people's representative- that's congress. Otherwise you could get a off-the-rails judge dropping indictments on people and somehow removing the highest elected official in the land from office. Not a good setup.

So even if criminal charges were brought, she's President until congress says she isn't.

From what I understand he is not reopening it because it was never technically closed
