Easy Pass Violation Notice Do I have to pay the $50?

Depends on the circumstance.

If you car did not have an EZ Pass and your relative had a car with an EZ Pass and is used to going though EZ Pass lanes then its an understandable mistake on your relatives part. But your relative is still obligated to pay "your" fine. You could try appealing and explaining to EZ Pass and hope they'll waive the fine.

ps - Obligation or not, personally, a $50 violation because of a mistake by a relative wouldn't bother me. If it happened to me, I myself, would simply pay it and next time I saw my relative I'd tell him or her to try to be more careful.

When a relative invites me or I invite one over for a BBQ or to stay overnight the value being hosted is a lot more than $50. No expects to pay. $50 is really trivial in the scheme of things when it comes to relatives. Its not something worth getting aggravated about.


Clarifying the situation, this is for a friend. Relative is a dependent adult child who can not pay and probably did not have change for the toll. Is there an excuse that is relevant here?


Call ez pass, they'll tell you to write a letter and wave the fee.


Send the violation form back with the actual toll amount and a letter explaining the circumstance. Say something like he thought his EZ pass was working ) assuming they have one

If it was just an over sight. You can try saying that the relative borrowed the car and planned to hold the transponder up as he drove through the toll, but dropped it accidentally and proceeded through the toll to avoid risking an accident by stopping in the lane to look for it. If the notices are the same, they say that if you did have a transponder and for one reason or another it didn't work to just list the transponder info and they waive the fine. Of course, you would have to have a valid transponder number from a relative.


If you personally have a transponder for that car....you can say it had fallen down and he didn't realize it...


I didn't have the money so therefore I drove through is not an acceptable excuse.


And next time you lend the car, include an EZpass.....if you don't have one..get one just for this!

  1. Just call them. If you don't have a ton of past violations on your car already they will waive it. If the first operator you get won't do it call back and ask another.

I think the bottom line is that it was your car that committed the violation and you as the owner are responsible. If it was a stolen car, that would be different. I agree, it doesn't hurt to try calling and getting an exception or waiving or reducing of the fee, but be prepared to pay it.

The last time I accidentally went through a toll without paying (I didn't realize the transponder or whatever wasn't in the car window) the fee was more like $11 or $20, nothing close to $50. That's exorbitant!


No. This happens to me all the time because I do not use automatic replenishment (I don't want them to have all my money up front). Just call and tell them you'll pay it over the phone; they'll take your credit card and waive the ersatz fine.


If the car doesn't have an EZ pass, I can't imagine what possible excuse there could be for driving through without paying a toll. "I didn't have any $" doesn't cut it

Really, they will waive the fine even if you willfully tried to evade the toll? Even though the car does not have its own transponder, it is possible to use a transponder from another car. I once had a friend give me rides in his car when I couldn't drive temporarily. When we went through tolls, I took the transponder from my car and just held it up to the window as we went through tolls. It worked every time.


You could claim you were using a transponder from another car. I don't know if that is technically allowed in the regulations though....


Technically I don't think you are allowed to use your transponder in a different car than it was registered for. So that wouldn't be a good strategy.

If you borrow a car, you can use your own EZ-pass. I do it all the time when I have a loaner car if my car is in the shop (I'm on a commuter plan and the price difference is considerable). If for some reason it fails to register at one of the tolls, you get a violation. Then you have to call up and explain that it was a temporary vehicle, give them your EZ-pass tag number, and they remove the $50 violation. So if the borrower has an EZ-pass that they normally use, they should be able to do this without any problem.


Sure you could, if I drove my friend around for a couple weeks while she was visiting from south jersey, she could register her transponder to my car for that time period, and then change it back when she goes home ....


You would just say it was that friend who actually has a transponder who was driving the car at that time. Just make sure they were home or parked at work or the mall at a time that would correspond with the real driver that day.

You don't need a transponder at all. Get an EZ pass acccount, register all your cars online with license plate. Based on license plate the tolls will post to the account.

Do you do that? Because, I think you've given bad advice.

Not having an EZ Pass mounted is technically a violation. As a courtesy, they usually waive the violation and just assess the toll when the EZ pass did not work.

They abhor what you suggest. Passing an EZ Pass toll without EZ Pass registering involves manual labor. Someone has to retrieve the video when the toll was passed and take from that the license plate. Then they do a license plate lookup and see if that plate is registered with EZ Pass. If not a violation is sent. If the picture shows the vehicle does not have a mounted EZ Pass tag they can send a violation even if the plate is registered.

Under what conditions can I get a violation?There are two situations in which you can receive a violation:
  1. Toll Evasion: When you drive through a lane without a valid E-ZPass tag being properly mounted in your vehicle.
  2. Insufficient Funds: When your account is insufficient and you travel through an "E-ZPass Only" lane.
  3. Class Mismatch: When the vehicle class of the tag you are using does not match that of the vehicle you are driving.

It works in practice. I was told this a couple years ago on the phone with EZ Pass customer service.

And, proof of concept -- been that way for several years at least! I have the transponder in my main car, not in the other 2 family cars. Tolls post every month on my statement from the other 2 cars with their plates listed.

you can use the transponder in any car. If however you are driving in the car that's registered and the transponder doesn't work then they will bill the licence plate, if the cars is NOT registered for EZPass you'll get a ticket.


Recently got a red light camera ticket for $80.00 while driving in wife's uncle's funeral procession, police escort and all.

The only way to fight it would be to show up for the court date all the way in Nassau L.I. which no-can-do.

I'm sure I was not the only one in the line to be ticketed.

Tried to call and of course no way to talk to a real human.

Gritted my teeth and paid the damn ticket.


If this has not happened before write the check for 1.50 with an explanation. Your relative borrowed the car and forgot to bring her ezpass give her expass number. Or that she thought you had ezpass. They are pretty good at giving a pass the first time. You can call them also and explain. I would not pay the 50 without first wtiting n explanation. If u do not hear back they r accepting the 1.50. It happens all the time.


If you say they just forgot the ezpass, you will need to provide an account number.
