Town tree question

The town tree on my berm looks awful.  Last year, PSE&G came by to trim the branches of town trees on my street in Maplewood and they did a HORRIBLE job.  It's actually an eyesore to my property.  In addition, I noticed that the roots have grown far beyond the berm and will most likely begin to cause a problem for the sidewalk which is an expense I would prefer not to incur.  I submitted a request to have the tree removed on the township's website.  If they reject my request, am I legally allowed to hire a contractor at my expense to remove the tree even though it's a town tree?  


No, if it is rejected for removal and you hire a contractor (that will even attempt doing this) you and the contractor will be fined.

Most contractors know which trees are yours and which belong to the town.  They also know that even if it was your tree they would need to file for a permit and would be fined if they cut it down when a permit is denied.

I have seen fines of up to $1250. For a contractor not filing for a permit.


Thank you for your help.  I'm happy to announce that they are taking down the tree as I type this!  I assumed I would be denied because the tree wasn't dead yet but it was definitely interfering with the electrical wires and about to become a problem for our sidewalks.  DPW has been very quick and helpful with this!  

On another note, I really wish PSE&G didn't butcher the trees around here.  I know they need to be trimmed but there has to be a way for them to do it where it's more aesthetically pleasing.  They did this to a bunch of trees on my street and it looks terrible.
