paychex failing to process withdrawal

I have been trying to withdraw my 401K since about august of last year.  I had to stop fighting at one point because I was too sick.  i tried again about a month ago and they are still insisting on acting stupid.


1st, they sent me a fake letter claiming i needed to roll over my account since it was inactive.  it instructed me to fill out the included forms and fax back and email with questions.

There were no forms included.  They did not respond to email or a faxed letter. The only 2 ways they gave for contact.  I had been considering starting withdrawal before I got the fake letter.


I filed a BBB complaint, started getting responses, but got the run around.


Got in touch with another person about a month ago.  Their idea of professional and ethical work is to send a request to my former employer and the do nothing when they don't get a response...even though I have reminded them numerous times.  They claim they need the employer to verify I am disabled....employer has no verification of that.....only that I left work citing health reasons.


Is there any state agency that over sees a company like paychex?  I can't afford lawyer and free legal services are not a viable option.


I was thinking about driving to their nearest office and plastering signs on their walls begging them to do their job....

i got a supervisor to respond...although with lies....claiming they are ACTIVELY addressing the issue (Since last august).   they send a request to the employer and do nothing when they don't get a response...even though I have reminded them numerous times.

they claim my employer needs to fill out a form saying they certify I am disabled as per medical documentation....but my employer doesn't have any medical documentation...and can't sign the form.  all they can document is that I no longer work there....and I told paychex that long ago.


i give paychex until tomorrow to stop acting stupid before I take the next step.


Dept of labor or Department of Consumer Affairs. Consumer Affairs may be more likely because Banking and Insurance is associated with that department.
