NJ or NY Temporary Disability???

EricBurbank

I wanted to see if anyone here has any knowledge of how this works before I go searching on line or spend hours on the phone.

If you live in NJ but work in NY and you get injured and have to go on temporary disability, which state do you file through?  It would be the same if you were to file for unemployment.

How long do you need to be out of work for before you can collect?

How long can you collect?

What is the maximum per week?

Thanks in advance for any help you can give.

I think it's generally the state where the employer is located. This is from the New Jersey Department of Labor, which seems to suggest to start by talking to the employer. Once you know what state, they can provide the other info.

"In order to have a valid application for New Jersey Temporary Disability Insurance, you need to have paid into the program through your employment and meet minimum gross earnings requirements. These requirements may change year to year.

Check your pay stub or ask your employer to see if you have been contributing to the state plan or a private plan."

In NJ, minimum gross earning requirement is about $172/week for at least 20 weeks. Claimants are paid two-thirds (2/3) of their average weekly wage, up to a maximum set at the beginning of each calendar year. For 2019, the maximum weekly benefit is $650.

"You have 30 days from the first day of your disability to file your application. If your application is received more than 30 days from the first day of your disability, you must provide a reason why the claim was not filed on time. Benefits may be reduced or denied for late applications."

Oh great.  My son is not going to be happy with that.  I can only imagine the forms and calls this is going to require.

It’s where you work/where the employer is. NY benefits significantly less.

I dont understand how NY manages to get away with being so dam cheap.  Not just with benefits but their pay rates for government employees too.

Unless they take out less for the benefits.
