Go to USPTO.gov
It will take you less then an hour and be much less expensive

I have been to the USPTO website but I have a slightly more complicated issue in that the name that I want is being used by a company in a very different field so need guidance if I can still use it or what I would need to do in the application to increase my chance of being able to secure it in my field.....
I guess it depends on how geographically close the other company is and how extensively your business will be marketed. Also, how close the product is. If there are other similar names nearby, consider another trade name.
There are probably 3,000 Joe's and Joey's pizza in the U.S.
Trade names can also be registered in the Essex County Hall of Records.

Very good perspective. Their work is similar'ish...and they are backed by a major company so I'd probably lose any sort of battle. Thanks so much for taking the time to provide your comments. Really appreciate it.
